1. Definitions
“VacPumpSpares”, “we”, “us”, or “our” refers to VacPumpSpares, operating from Sutton Coldfield, West Midlands, UK. “Customer”, “you”, or “your” refers to the person or company placing an order or requesting a quote. “Goods” refers to vacuum pump spare parts and related products supplied by us.
2. Quotations & Orders
All quotations are valid for 30 days from the date of issue unless otherwise stated. Prices quoted are exclusive of VAT unless stated otherwise. We reserve the right to withdraw or amend a quotation at any time before formal acceptance. An order is deemed accepted only upon our written confirmation or dispatch of goods.
3. Prices & Payment
All prices are quoted in GBP (British Pounds Sterling) and are exclusive of VAT at the prevailing rate. Payment terms for account customers are 30 days from date of invoice unless otherwise agreed in writing. For non-account customers, payment is required prior to dispatch. We reserve the right to charge interest on overdue payments at 8% above the Bank of England base rate.
4. Delivery
We aim to dispatch all in-stock items ordered before 3:00pm on the same working day. Standard delivery is next working day to UK mainland addresses via tracked courier service. Delivery times are estimates and not guaranteed. We shall not be liable for any loss or damage arising from late delivery. Risk in the goods passes to the customer upon delivery.
5. Returns & Refunds
Goods may be returned within 14 days of delivery provided they are unused, in original packaging, and in resaleable condition. Returns must be authorised in advance by contacting us. A restocking fee of up to 15% may apply to non-faulty returns. Carriage costs for returns are the responsibility of the customer unless the goods are faulty or incorrect. Refunds will be processed within 14 days of receiving returned goods.
6. Warranty
All genuine manufacturer parts carry the original manufacturer's warranty. OEM-equivalent parts are warranted against defects in materials and workmanship for a period of 12 months from date of delivery. Warranty does not cover damage caused by misuse, incorrect installation, normal wear and tear, or use in applications for which the part was not designed. Our liability under warranty is limited to replacement of the defective part or refund of the purchase price.
7. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising out of or in connection with the supply of goods shall not exceed the price paid for those goods. We shall not be liable for any indirect, consequential, or special losses including but not limited to loss of profit, loss of production, or loss of business opportunity. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
8. Part Identification
While we make every effort to ensure correct part identification, it is the customer's responsibility to verify that parts ordered are suitable for their specific application. We recommend confirming pump model numbers and serial numbers when ordering. Parts ordered by part number are supplied as requested; we cannot accept liability for incorrect part numbers provided by the customer.
9. Force Majeure
We shall not be liable for any delay or failure in performance resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, government actions, supply chain disruptions, pandemics, or failure of third-party suppliers.
10. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
